1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of The Punta Cana Venue Collection and any Services offered through it. By using the Site, you agree to these Terms and to our Privacy & Cookie Policies.
2. Who We Are
The Site is operated by The Punta Cana Venue Collection, based in the Dominican Republic. Contact: puntacanavenuecollection@gmail.com.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. If you use the Services on behalf of a business, you represent you have authority to bind that business.
4. Services & Scope
We curate venue listings in Punta Cana and surrounding areas and provide tools to inquire, shortlist, and book venue inspection services. We are not the owner/operator of most venues; final availability, pricing, terms, and service performance are the responsibility of the venue provider or third‑party vendor.
5. Accounts & Submissions
You agree that information you provide is accurate and up‑to‑date. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. By submitting content (e.g., reviews, messages, photos), you grant us a worldwide, royalty‑free license to use, reproduce, display, and distribute such content in connection with the Services. You represent you have the necessary rights.
6. Bookings, Payments & Cancellations
Some Services (e.g., inspection scheduling) may require a fee or deposit. Prices, taxes, currency, and payment terms will be shown at checkout or in a proposal. Cancellation and rescheduling terms will be displayed at the time of booking. Venue‑specific deposits, minimums, and cancellation policies are set by the venue. We are not responsible for venue changes or closures but will use reasonable efforts to assist with alternatives or refunds according to the applicable policy.
7. Vendor/Venue Listings
Venues are responsible for the accuracy of their listings (amenities, capacity, availability, permits). We may moderate listings but do not guarantee completeness or accuracy. You should verify all details directly with the venue before making commitments.
8. Prohibited Uses
You agree not to: (a) misuse the Site; (b) scrape or harvest data except as permitted by robots.txt; (c) infringe intellectual property or privacy rights; (d) upload malicious code; (e) circumvent access controls; (f) use the Services for unlawful purposes.
9. Intellectual Property
All content on the Site (text, branding, graphics, layout) is owned by or licensed to The Punta Cana Venue Collection and protected by IP laws. You may not copy, distribute, or create derivative works without permission, except as permitted by law.
10. Disclaimers
The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant uninterrupted or error‑free operation or the accuracy of third‑party content.
11. Limitation of Liability
To the maximum extent permitted by law, The Punta Cana Venue Collection and its directors, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or Services. Our total liability for any claim shall not exceed the greater of (i) the amounts you paid to us for the relevant Service in the 12 months before the claim, or (ii) USD $100.
12. Indemnification
You agree to defend, indemnify, and hold harmless The Punta Cana Venue Collection from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms or misuse of the Services.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Dominican Republic, without regard to conflict‑of‑law rules. You agree to the exclusive jurisdiction and venue of the courts located in La Altagracia Province, Dominican Republic (or a mutually agreed arbitration forum) for any disputes, unless applicable consumer law provides otherwise.
14. Changes to the Terms
We may modify these Terms by posting an updated version with a new Effective date. Continued use of the Site after changes constitutes acceptance.
